Briteglo Terms of Service

These Terms of Service (the “Agreement”) constitute a binding legal contract between you (“User”, “you”) and TN Unlimited LLC, doing business as Briteglo (“Briteglo”, “we”, “us”, “our”), governing your access to and use of the Briteglo website, online store, mobile applications, and any related services or features (collectively, the “Services”). By accessing, browsing, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement, as well as our Privacy Policy located at https://brite-glo.com/policies/privacy-policy, which is hereby incorporated by reference. If you do not agree, you must immediately discontinue use of the Services.
By using the Services, you represent and warrant that you are at least the age of majority in your jurisdiction of residence or have obtained lawful parental or guardian consent. You agree to provide accurate, current, and complete information when creating an account or submitting information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Briteglo reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion.
All orders placed through the Services constitute an offer to purchase, which may be accepted or rejected by Briteglo in its sole discretion. We reserve the right to impose limits on quantities purchased, refuse or cancel orders suspected of fraud, abuse, or resale, and require accurate billing, payment, and shipping details. Your purchases are further governed by our Refund Policy, available at https://brite-glo.com/policies/refund-policy, which is incorporated herein by reference. Returns or exchanges will not be honored except in strict accordance with that policy.
All prices are denominated in U.S. Dollars unless otherwise specified and are subject to change without notice. Taxes, shipping, handling, duties, and customs fees may apply. Briteglo reserves the right to modify or discontinue any aspect of the Services at any time, without liability to you or any third party.
We endeavor to display products and descriptions accurately; however, we do not guarantee that product images, colors, or other content are error-free or will match the appearance on your device. All products offered by Briteglo are intended solely for cosmetic use and are not designed, marketed, or intended to diagnose, treat, cure, or prevent any disease. By purchasing our products, you agree to discontinue use if irritation occurs and to consult a qualified healthcare provider when necessary. Products should be patch-tested prior to full application. Nothing contained on the Services constitutes or should be construed as medical advice.
All delivery timelines are estimates only. Title and risk of loss transfer to you upon our delivery of products to the carrier. We disclaim liability for carrier delays, customs clearance issues, or events beyond our reasonable control.
By providing your email address, telephone number, or other contact information, you expressly consent to receive communications from Briteglo, including marketing messages, in compliance with applicable laws such as the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. You may withdraw consent at any time by following the instructions provided in such communications. Standard message and data rates may apply. STOP and HELP commands will be honored consistent with regulatory requirements.
All content, trademarks, service marks, trade names, logos, product names, designs, text, graphics, images, and software made available through the Services are the exclusive property of Briteglo, its licensors, or third parties. Except as expressly permitted by law, you may not copy, reproduce, modify, distribute, publicly display, or create derivative works of any such content without prior written authorization from Briteglo. Unauthorized use may violate intellectual property laws and is strictly prohibited.
The Services may provide access to third-party tools, applications, or links to external websites. Briteglo provides such access without warranties and accepts no responsibility for third-party content or services. Your use of any third-party resources is at your sole risk and subject to the third party’s terms of use and privacy policy.
Any suggestions, reviews, comments, ideas, or other submissions provided by you shall be deemed non-confidential and shall grant Briteglo a perpetual, worldwide, royalty-free, transferable license to use, reproduce, distribute, modify, and otherwise exploit such submissions for any lawful purpose. You represent and warrant that your submissions do not infringe third-party rights and are not unlawful, defamatory, obscene, or otherwise objectionable.
You agree not to use the Services for any unlawful purpose or in violation of any applicable law or regulation, including but not limited to: infringing intellectual property rights; engaging in harassment, abuse, or discrimination; transmitting viruses or malicious code; engaging in fraudulent, misleading, or deceptive conduct; scraping or data-mining; or interfering with security features of the Services. Briteglo reserves the right to investigate and take legal action for any prohibited conduct.
The collection, use, and sharing of personal data are governed by our Privacy Policy at https://brite-glo.com/policies/privacy-policy. Because our Services are hosted by Shopify, certain personal data is processed and stored by Shopify and its affiliates. Users in jurisdictions such as the European Union and California have specific rights under GDPR and CCPA, including rights of access, correction, deletion, and portability. Requests to exercise these rights may be directed to info@brite-glo.com.
THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. BRITEGLO DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BRITEGLO, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BRITEGLO’S AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE AT ISSUE.
You agree to indemnify, defend, and hold harmless Briteglo, Shopify, and their affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (i) your use of the Services, (ii) your violation of this Agreement, or (iii) your violation of any law or rights of a third party.
Briteglo shall not be liable for any delay or failure in performance resulting from events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, strikes, labor disputes, supply chain disruptions, epidemics, pandemics, or governmental actions.
Briteglo may suspend or terminate this Agreement and your access to the Services at any time, with or without notice, for conduct that it believes violates this Agreement or is otherwise harmful to Briteglo’s interests. Provisions that by their nature should survive termination, including without limitation intellectual property, indemnification, disclaimers, limitations of liability, and dispute resolution, shall survive.
This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Any dispute or claim arising under this Agreement shall be resolved exclusively by binding arbitration conducted in Oregon under the rules of the American Arbitration Association. You waive any right to participate in a class action, class arbitration, or other representative action. Notwithstanding the foregoing, Briteglo may seek injunctive or equitable relief in any competent court.
Briteglo endeavors to make its Services accessible to all users, including individuals with disabilities. Requests for accessibility assistance may be directed to info@brite-glo.com.
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any provision shall not constitute a waiver of that provision or any other provision.
You may not assign or transfer this Agreement without prior written consent from Briteglo. Any attempted assignment in violation of this provision is null and void. Briteglo may assign this Agreement without restriction.
This Agreement, together with the policies incorporated by reference, constitutes the entire understanding between you and Briteglo with respect to the Services and supersedes any prior agreements, written or oral.
Briteglo reserves the right to amend or modify these Terms at any time by posting the revised version on its website. Material changes will be notified to users in accordance with applicable law. Continued use of the Services after changes are posted constitutes acceptance.
